Terms of Service

Emergency notice — read first
SwiftAid is NOT a substitute for official emergency services. In any medical emergency you must first dial 112 (Haryana Emergency Response), 102 (National Ambulance) or 108. SwiftAid is a community coordination tool that helps volunteer/partner ambulance crews and hospitals in Yamuna Nagar respond faster; it does not employ paramedics, own ambulances, or provide medical care of any kind. Use of this platform is at your own risk. If SwiftAid does not dispatch a unit, is slow, is unavailable, or the assigned crew or hospital cannot help you, call 112 / 102 / 108 immediately.
1. Who we are
SwiftAid ("we", "us", "the Platform") is a good-faith, non-commercial community-safety software project serving Yamuna Nagar, Jagadhri and surrounding areas of Haryana, India. The Platform connects patients and bystanders with independent ambulance crews, ambulance operators, hospitals, and volunteer dispatchers. SwiftAid is a communications intermediary and information service only. We are not a healthcare provider, medical practitioner, ambulance operator, or emergency-service authority.
2. Nature of the service — no medical service, no guarantee
- The Platform is provided on a strictly "AS IS" and "AS AVAILABLE" basis, with all faults, without warranty of any kind, express or implied.
- We make no representation, promise, guarantee or commitment that: (a) an ambulance will be dispatched, (b) any dispatch will arrive within any particular time (including any published estimates such as "under 10 minutes" or "under 90 seconds", which are aspirational targets only), (c) any hospital shown as "active" has capacity or the specific capability you need at the moment of arrival, (d) any crew member or driver is currently trained, certified, sober, licensed or fit to provide care, (e) the ETA, route, GPS position, hospital availability, bed count or status shown in the app is accurate or up to date, or (f) the Platform will be available, uninterrupted, secure, or free from errors.
- Estimated times of arrival, routes, and landmarks are computed from third-party APIs (including Google Maps) and driver-reported GPS. They may be wrong, delayed, or absent. Do not rely on them as the sole basis for any life-or-death decision.
- Verification of a hospital or crew member as "active" or "approved" is an administrative review of their submitted paperwork only. It is not a certification of medical competence, licensure, insurance, or fitness to treat you.
3. Your responsibilities as a patient / bystander
- Always call 112 / 102 / 108 first in a life-threatening situation.
- You are responsible for the accuracy of the information you enter (type of emergency, location, phone number, medical profile, "I am the patient" flag).
- You will not use the Platform to send false alarms, hoaxes, prank requests, or requests on behalf of a person who has not consented; doing so may be a criminal offence under Indian law (including Section 353 of the Bharatiya Nyaya Sanhita and equivalent provisions).
- You consent to your location, phone number, and other submitted data being shared with dispatched crew, the receiving hospital, and (where required) administrators, so they can help you.
- You are responsible for all charges levied by any ambulance operator or hospital that ultimately treats you. SwiftAid does not bill you, is not party to any transport or medical services contract, and does not underwrite payment.
4. Your responsibilities as a crew member, driver or ambulance operator
- You represent and warrant that all information you submit (name, callsign, certification, vehicle number, EMT expiry, base hospital) is true, current and complete, and that you hold all licences, permits, insurance and certifications required by law to operate the vehicle and provide the level of care you offer.
- You are solely and independently responsible for the care you provide, driving conduct, patient handling, and compliance with all applicable laws (including the Motor Vehicles Act, 1988; the Clinical Establishments Act; Haryana State transport rules; and any professional standards of the AIIMS/State EMT curriculum).
- You use SwiftAid at your own discretion. You may accept, decline, cancel or divert any dispatch based on your own professional judgement. Nothing in the app instruction or "suggested route" overrides your professional judgement or road-safety obligations.
- SwiftAid is not your employer, principal, agent, contractor or partner. No employment, agency, joint venture, or franchise relationship is created.
- You will keep your on-duty / off-duty status current and will not remain "on-duty" if you are unable to respond.
5. Your responsibilities as a hospital
- You represent and warrant that you hold all statutory registrations (including Clinical Establishments Act registration where applicable) and that the capabilities, bed and ICU counts you publish are accurate at the time you publish them.
- You will update capacity in real time and mark yourself inactive if you cannot receive patients.
- You accept that SwiftAid does not screen patients medically or triage clinically and that you retain full clinical and legal responsibility for accepting, refusing or transferring any patient.
6. Disclaimer of warranties
To the maximum extent permitted by law, SwiftAid, its founders, contributors, volunteers, hosts and licensors disclaim all warranties of any kind, express, implied, statutory or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, non-infringement, availability, and freedom from viruses or errors. No advice or information obtained through the Platform creates any warranty not expressly stated in these Terms.
7. Limitation of liability — READ CAREFULLY
To the maximum extent permitted by law, in no event will SwiftAid, its founders, contributors, volunteers, administrators, hosts, licensors or affiliates be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or aggravated damages, including without limitation damages for personal injury, death, disability, pain and suffering, loss of life, loss of earnings, loss of profits, loss of data, loss of use, loss of goodwill, medical expenses, or funeral expenses, arising out of or in any way connected with (a) your use of or inability to use the Platform; (b) any delay, non-arrival, wrong dispatch, wrong hospital, wrong route or wrong ETA; (c) any act, omission, negligence, misconduct, or malpractice of any ambulance crew, driver, ambulance operator, hospital, doctor, nurse or other third party contacted through the Platform; (d) any interruption, error, defect, virus or delay in operation or transmission of the Platform; (e) any loss of, or unauthorised access to, your data; or (f) any content posted or transmitted through the Platform, whether based in warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not SwiftAid has been advised of the possibility of such damages.
Where any liability cannot be excluded by law, the aggregate liability of SwiftAid and everyone associated with it, for any and all claims arising out of or relating to the Platform, is limited to one hundred Indian Rupees (INR 100) or the minimum amount that cannot be excluded under applicable law, whichever is greater. You acknowledge that this allocation of risk is a fundamental part of the bargain and that we would not provide the Platform without it.
8. Indemnity
You agree to defend, indemnify and hold harmless SwiftAid and its founders, contributors, volunteers, administrators, hosts, licensors and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, penalties and expenses (including reasonable legal fees) arising from: (a) your use of and access to the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any right of privacy, publicity, or intellectual property; (d) any claim that your submitted content or use caused damage to a third party; and (e) if you are a crew member, driver, operator or hospital, any claim by a patient, family member, regulator, insurer or third party relating to the care, transport, refusal, delay or diversion you provided or failed to provide.
9. Third-party services
The Platform integrates with third-party services (including Google Maps Platform, Supabase, Lovable, AI model providers, and telecom carriers). Their availability, accuracy and terms are outside our control. We accept no responsibility for their failures.
10. Acceptable use
You will not: (a) submit false emergencies; (b) impersonate a crew member, hospital, official or another person; (c) attempt to interfere with, reverse-engineer, overload, scrape or probe the Platform beyond ordinary use; (d) upload or transmit malicious code; (e) use the Platform to collect data about other users; or (f) use the Platform in any way that violates any law or the rights of any person. We may suspend or terminate access at any time, without notice, for any reason, including suspected abuse.
11. Suspension, termination, changes
We may modify, suspend, or discontinue the Platform (in whole or in part) at any time, without notice and without liability. We may change these Terms at any time by posting an updated version; continued use after changes constitutes acceptance.
12. Governing law and jurisdiction
These Terms are governed by the laws of India and the State of Haryana, without regard to conflict-of-laws rules. Subject to the arbitration clause below, the courts at Yamuna Nagar / Jagadhri, Haryana, shall have exclusive jurisdiction.
13. Dispute resolution — informal first, then arbitration
Before filing any claim you agree to first send us a written notice describing the dispute and to negotiate in good faith for at least sixty (60) days. Any unresolved dispute shall then be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator seated in Yamuna Nagar, Haryana, conducted in English or Hindi. Each party bears its own costs. This clause does not prevent either party from seeking urgent injunctive relief from a competent court.
14. Severability, waiver, entire agreement
If any provision is held unenforceable, the remaining provisions remain in full force. No failure or delay in exercising a right is a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and SwiftAid regarding the Platform.
